Bet Your Company: When Major Litigation Hits!

Many boards of directors do not have action plans in place  when their corporation is targeted with litigation, including when board members are named as defendants to the lawsuit. Boards should be aware of red flags to watch out for, their legal duties when the corporation is sued, best practices to respond to litigation, and their ability to retain their own legal counsel separate from the corporation. The board should have this critical knowledge well in advance of being hit with a lawsuit alleging wrongdoing or negligence by the corporation, so that the board can quickly and effectively respond in a way that best protects corporate interests.
